1) Scope of Application

1.1 These General Terms and Conditions (hereinafter "GTC") of Steffen Foullon (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller regarding the goods offered by the Seller in their online shop. The inclusion of the Customer's own conditions is hereby rejected, unless otherwise agreed.

1.2 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly outside of their commercial or self-employed professional activity. An entrepreneur within the meaning of these GTC is a natural or legal person, or a legally capable partnership, who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.


2) Conclusion of Contract

2.1 The product descriptions in the Seller's online shop do not represent binding offers from the Seller, but rather serve as an invitation for the Customer to submit a binding offer.

2.2 The Customer can submit the offer via the online order form integrated into the Seller's online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the Customer makes a legally binding offer by clicking the button that completes the ordering process. The Customer can also submit the offer to the Seller by phone or email.

2.3 The Seller can accept the Customer's offer within five days by sending a written order confirmation or an order confirmation in text form (fax or email), whereby the receipt of the order confirmation by the Customer is decisive, or by delivering the ordered goods to the Customer, whereby the receipt of the goods by the Customer is decisive, or by requesting the Customer to make payment after submitting the order. If several of the aforementioned alternatives occur, the contract is concluded when one of these alternatives first takes place. The deadline for accepting the offer begins on the day following the Customer's submission of the offer and ends at the close of the fifth day after the offer was submitted. If the Seller does not accept the offer within this period, the offer is deemed rejected, and the Customer is no longer bound by their declaration of intent.

2.4 When submitting an offer through the Seller's online order form, the contract text is stored by the Seller and sent to the Customer in text form (e.g., email, fax, or letter) along with these GTC after the Customer has submitted their order. Additionally, the contract text is archived on the Seller's website and can be accessed by the Customer free of charge via their password-protected customer account, provided the Customer has created a customer account in the Seller's online shop before submitting the order.

2.5 Before binding submission of the order via the Seller's online order form, the Customer can identify potential input errors by carefully reading the information displayed on the screen. A helpful technical means for better identification of input errors is the browser's zoom function, which allows enlarging the display on the screen. The Customer can correct their entries during the electronic ordering process as long as they have not clicked the button completing the order process.

2.6 The contract language is exclusively German.

2.7 The order processing and communication usually take place via email and automated order processing. The Customer must ensure that the email address provided for order processing is correct, so that emails sent by the Seller can be received. In particular, the Customer must ensure that all emails sent by the Seller or by third parties appointed by the Seller for order processing can be delivered, especially when using SPAM filters.


3) Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.

3.2 Further information on the right of withdrawal can be found in the Seller's withdrawal policy.


4) Prices and Payment Terms

4.1 Unless otherwise stated in the product description, the prices indicated are total prices. VAT is not shown as the Seller is a small business under the German VAT law (UStG). Any additional shipping and delivery costs are separately stated in the respective product description.

4.2 In the case of deliveries to countries outside the European Union, additional costs may arise that are not covered by the Seller and must be borne by the Customer. These include, for example, fees for money transfers by banks (e.g., transfer fees, currency exchange fees) or customs duties and taxes (e.g., customs duties). Such costs may also arise if the Customer makes the payment from a country outside the European Union, even if the delivery is not made to a country outside the European Union.

4.3 The payment options will be communicated to the Customer in the Seller's online shop.

4.4 If prepayment by bank transfer is agreed, payment is due immediately after the contract is concluded, unless the parties have agreed to a later due date.

4.5 If payment is made via a PayPal payment method, the payment processing is carried out by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal") under the applicable PayPal user agreement, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full, or – if the Customer does not have a PayPal account – under the terms for payments without a PayPal account, available at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full.


5) Delivery and Shipping Terms

5.1 The delivery of goods will be made by shipping to the delivery address provided by the Customer, unless otherwise agreed. The delivery address specified in the Seller's order processing is decisive.

5.2 If the transport company returns the shipped goods to the Seller because delivery to the Customer was not possible, the Customer shall bear the costs of the failed shipment. This does not apply if the Customer is not responsible for the circumstance that led to the impossibility of delivery, or if they were temporarily prevented from accepting the offered performance, unless the Seller had announced the performance to the Customer a reasonable time in advance. Furthermore, this does not apply to the shipping costs if the Customer effectively exercises their right of withdrawal. In the case of effective withdrawal, the regulation in the Seller's withdrawal policy applies to the return shipping costs.

5.3 Self-pickup is not possible for logistical reasons.


6) Retention of Title

If the Seller delivers goods in advance, they retain ownership of the delivered goods until the purchase price has been paid in full.


7) Warranty (Defects Liability)

7.1 If the purchased goods are defective, the statutory provisions on defects liability apply.

7.2 The Customer is requested to report any apparent damage to the goods during transport to the carrier and notify the Seller accordingly. Failure to do so has no impact on the Customer's statutory or contractual rights related to defects.


8) Applicable Law

For all legal relationships between the parties, the law of the Federal Republic of Germany applies, excluding the laws on the international sale of goods. This choice of law applies to consumers only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.


9) Alternative Dispute Resolution

9.1 The EU Commission provides a platform for online dispute resolution at: https://ec.europa.eu/consumers/odr. This platform serves as a contact point for the extrajudicial settlement of disputes arising from online purchase or service contracts involving a consumer.

9.2 The Seller is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
